Kansas lawmakers offer new plan on coal-fired plants as last offer to governor

TOPEKA, Kan. (AP) -- Legislative leaders on Thursday offered a final compromise plan to Gov. Kathleen Sebelius to ensure two proposed coal-fired power plants are built.

Sebelius, who has already vetoed two bills to allow the plants, was skeptical but said she would consider the plan. The two bills already vetoed by Sebelius would also have limited the power of the secretary of health and environment, who has blocked the plants since October.

The latest plan still would permit Sunflower Electric Power Corp. to build the plants outside Holcomb, in Finney County. But they would be 14 percent smaller than the utility had proposed -- cutting their carbon dioxide emissions.

Lawmakers also would impose more-aggressive goals than previously approved for requiring utilities to develop wind farms and other sources of renewable energy. Sunflower also would create programs to help consumers conserve energy and join an international registry tracking greenhouse gas emissions.

"It has a number of the elements of the two bills that I've already vetoed, but I'm going to take some time and, you know, analyze the newer features and talk to the secretary and get some expert advice," Sebelius told reporters.

Senate President Steve Morris, House Speaker Melvin Neufeld and other Sunflower allies aren't backing away from the proposals to strip some power from the secretary of health and environment -- which Sebelius strongly opposes.

"It's really not a compromise," said Bruce Nilles, the director of the Sierra Club's national anti-coal campaign. "It doesn't help Kansas move forward and ties Kansas' future to the coal industry in Colorado and Wyoming."

But Sunflower spokesman Steve Miller said the company would make significant concessions by decreasing the size of the project, because it would lose "a lot" of potential revenue.

Secretary Rod Bremby denied an air-quality permit in October for Sunflower's project, citing its potential CO2 emissions. Many scientists link man-made greenhouse gas emissions to global warming.

Sunflower's project has bipartisan legislative support, and overriding Sebelius' latest veto last week is a key issue for legislators when they return Wednesday from their annual spring break.

Neufeld, an Ingalls Republican, and Morris, a Hugoton Republican, said they developed the proposal with electric cooperatives, including Sunflower.

They released it after the Democratic governor met with representatives of three companies. They were Sunflower; Midwest Energy Inc., a sister company; and Tri-State Generation and Transmission Association Inc., of Westminster, Colo., a partner in the Holcomb project.

Sebelius had offered Sunflower a deal in January to allow it to build one plant if it committed to developing new wind farms and conservation programs.

Sunflower rejected the proposal. The company said it is relying on Tri-State and another out-of-state partner to help finance the project, requiring the larger scope.

Neufeld and Morris said that if Sebelius doesn't respond by Wednesday, both chambers will attempt to override her latest veto. The governor said she will have an answer by then.
